New York requires basic infertility coverage across individual, small-group, and large-group plans when you meet the medical definition of infertility.
In addition, large-group fully insured policies (more than 100 employees) must cover up to 3 IVF cycles, including the medications that are part of each cycle.
Note: Self-funded (ERISA) employer plans and government programs follow different rules, so the details of your individual policy still matter. After your initial consult at Illume Fertility, a Financial Coordinator will help you confirm your eligibility.

Learn more about how the New York state infertility mandate works:
Ask HR if your plan is fully insured or self-funded and how many employees are covered. Check your Summary of Benefits and Coverage (SBC) or ID card for the insurer’s name.
If the plan is self-funded, New York’s state IVF mandate does not apply. We will always verify your plan details after your initial consult.
For large-group fully insured policies, medications tied to each covered IVF cycle are included in the benefit.
Anesthesia for egg retrieval is typically part of the covered cycle; prior authorization and a specialty pharmacy may still be required.
Storage that is "in connection with" the mandated IVF benefit is included until the three required IVF cycles are provided. Long-term storage beyond that varies by plan, so we encourage you to confirm these details with your insurer.
Yes. New York prohibits discrimination based on marital status, sexual orientation, sex, or gender identity. Coverage still depends on medical necessity and your plan’s rules, which we’ll review with you after your consult.
